General Terms for Drivers

These Terms and Conditions ("Terms") govern your use of the Stream Platform ("Platform") as a driver. By using the Platform, you agree to be bound by these Terms.

1. Definitions

  • Stream: the company that operates the Platform.
  • Driver: the person who uses the Platform to provide transportation services to passengers.

2. Eligibility

  • You must be at least 21 years old to use the Platform as a driver.
  • You must have a valid driver's license and a clean driving record.
  • You must have valid insurance and registration for your vehicle.

3. Platform use

  • You may use the Platform to provide transportation services to passengers.
  • You may not use the Platform for any other purpose.

4. Background check

  • Stream will conduct a background check on all drivers.
  • The background check will include a criminal record check and a driving record check.
  • Stream will also check for proof of identification, vehicle registration, insurance, and other relevant documents.
  • Stream reserves the right to reject or deactivate a driver's account based on the results of the background check.

5. Vehicle requirements

  • Your vehicle must meet Stream's requirements for age, condition, and safety.
  • You are responsible for ensuring that your vehicle is in good condition and meets all applicable safety standards.
  • You must have a valid and up-to-date vehicle inspection and maintenance records.
  • You must promptly report any accidents, damage, or safety issues to Stream.

6. Ratings and Feedback

  • Passengers will rate your performance as a driver.
  • Your rating will affect your ability to use the Platform.
  • You will have access to passenger ratings and feedback and can use them to improve your service.

7. Payment

  • You will receive payment for your services through the Platform.
  • Stream will deduct a fee from your payment for its services.
  • You will receive payment within a reasonable time after each completed ride.
  • You are responsible for reporting your income and paying any applicable taxes.

8. Confidentiality

  • You must keep all information related to Stream and its passengers confidential.
  • You may not disclose or use any such information for any purpose other than providing transportation services through the Platform.
  • You must comply with all applicable privacy laws and regulations.

10. Compliance with laws and regulations

  • You must comply with all applicable laws and regulations related to driving and transportation.
  • You must not engage in any behavior that could be considered discriminatory or harmful to passengers.

11. Dispute resolution

  • In the event of any dispute arising between the Driver and Stream, the parties agree to first attempt to resolve the dispute through negotiation and good faith discussions.
  • If the parties are unable to resolve the dispute within 30 days of initiating the negotiation process, either party may pursue any legal or equitable remedies available under applicable law.
  • All claims and disputes arising under or relating to these Terms or the use of the Platform shall be resolved by binding arbitration in accordance with the rules of the arbitration association agreed upon by the parties.

12. Indemnification

  • The Driver agrees to indemnify, defend, and hold Stream harmless from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorney's fees, arising from the Driver's use of the Platform, breach of these Terms, or any negligence or willful misconduct of the Driver.

13. Limitation of Liability

  • Stream will not be liable for any indirect, incidental, consequential, punitive or exemplary damages, including without limitation, loss of profits, goodwill, use, data or other intangible losses, arising out of or in connection with the Driver's use of the Platform.
  • The Driver acknowledges and agrees that Stream's total liability for any and all claims arising out of or in connection with these Terms shall be limited to the total amount of fees paid to the Driver by Stream during the six-month period immediately preceding the event giving rise to such claim.

14. Intellectual Property Rights

  • All intellectual property rights related to the Platform, including without limitation, all patents, copyrights, trademarks, trade secrets, and other proprietary rights, belong solely and exclusively to Stream.
  • The Driver is granted a limited, non-exclusive, non-transferable license to use the Platform solely for the purpose of providing transportation services to passengers.
  • The Driver shall not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from or through the Platform.

15. Termination

  • Either party may terminate these Terms at any time with or without cause.
  • If the Driver wishes to terminate these Terms, the Driver must provide notice to Stream and cease using the Platform.
  • If Stream wishes to terminate these Terms, Stream may do so immediately without notice and may also revoke the Driver's access to the Platform.

16. Miscellaneous

  • These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous agreements or understandings, whether oral or written.
  • If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • These Terms may not be assigned or transferred by the Driver without the prior written consent of Stream.
  • Stream may assign these Terms or any of its rights or obligations hereunder without the Driver's consent.
  • No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
